Selling Dubai Property from Germany: Process, Power of Attorney & DLD Transfer

A Dubai property can also be sold while you are in Germany. The key points are clear authority to act, complete documentation, a licensed broker and correct registration with the Dubai Land Department (DLD). This guide puts the process in context; it does not replace legal or tax advice.

Before listing: clarify ownership, documents and roles

A remote sale is easier when the ownership position, documents and decision-making routes are clear before marketing begins. Check who is registered as owner in the Title Deed or, for off-plan property, the relevant documentation, and who can sign or act with legal authority.

For ordinary property sale registration, DLD lists a valid passport for non-resident foreigners and, in freehold areas, an electronic no-objection certificate (e-NOC) from the developer. A mortgage, company structure, co-ownership, estate matter or off-plan position can bring additional steps. Align these cases with the relevant bodies and qualified advisers before marketing.

A complete digital file avoids assembling documents only shortly before transfer. The important question is not simply what is available, but which original, confirmation or clearance is required by the relevant party in your particular case.

  • Review the Title Deed or off-plan documents and owner details
  • Keep current identification documents for all parties available
  • Identify developer, lender and existing approvals early
  • Clarify outstanding service charges and a necessary e-NOC with the developer
  • Set out decision and communication routes for offers in writing

Assess market value with evidence – not listing prices alone

An asking price should be informed by comparable completed transactions and property-specific characteristics, not only by the original purchase price or visible asking prices. Through Dubai REST, DLD makes a Sale Index available and describes further information about property and market participants.

Compare units in the same building or community where possible. Floor level, view, layout, size, condition, renovations and letting position can materially affect value. A clear price strategy with a documented negotiation range helps assess incoming offers objectively.

Arrange the broker, marketing and power of attorney from Germany

For marketing, select a broker licensed in Dubai. DLD provides a public list of licensed real estate brokers through its website and Dubai REST. Check registration as well as the precise instruction, communication routine and documentation of viewings and offers.

For property advertising, DLD describes an advertising-permit process through the Trakheesi system. For brokers, DLD’s published page requires a marketing contract with the property owner for, among other things, online advertisements. Confirm with the broker who applies for the permit and how property details, photographs and access are documented.

DLD handles sale registration for buyers and sellers or their legally authorised representatives. If you do not travel to Dubai, align the power of attorney in advance with the Trustee Office, developer, lender and, where appropriate, legal advisers. For documents issued outside the UAE, the UAE Ministry of Foreign Affairs describes an attestation route through UAE missions abroad; the appropriate route depends on the issuer and document type, according to MOFA.

The official DLD transfer: verification, fees and registration

The DLD Property Sale Registration service describes the standard process at a Real Estate Registration Trustee Office: documents are verified, deficiencies are addressed and the transaction is entered in the system. Once fees are paid, the application is created and DLD provides the output electronically.

DLD lists ePay, Dubai Pay, Noqodi Wallet and Manager Cheque among payment methods. The suitable payment and settlement route for a particular sale depends on financing, contract documents, bank requirements and the parties involved, and should be agreed in writing before the appointment.

The standard fees currently published on DLD’s sale-registration page list 2% of the sale value for the seller and 2% for the buyer. DLD also lists further document, map and service-partner fees that can vary by case and sale value. Fees and allocation can change or differ by contract, so check the current DLD page and the exact agreement before completion.

Review German tax and reporting questions before signing

Anyone who is tax resident in Germany should review the tax position before a binding sale. Under section 23 of the German Income Tax Act, private disposals of property can be relevant where no more than ten years have elapsed between acquisition and sale. The law includes, among other things, an exception for certain owner-occupation cases and takes previously claimed depreciation into account when calculating profit.

The German Federal Ministry of Finance’s current overview lists the former double-tax treaty with the United Arab Emirates as applying only through 31 December 2021. The implications of an individual sale still cannot be reduced to a standard formula: personal tax status, holding period, use, company structure, acquisition costs and contract dates require qualified review.

Payment routes can also raise reporting questions. The Deutsche Bundesbank states that German residents generally must report payments exceeding EUR 50,000 or the equivalent to or from non-residents, with reporting generally due by the seventh working day after the end of the reporting month. Check applicability in good time with your bank, tax adviser or the Bundesbank based on the person, route and underlying transaction.

Stay operational from abroad

When selling from Germany, clear roles are more useful than a large number of participants. Agree who arranges key access, how viewings are documented, where offers and approvals are kept and who gives legally effective instructions. For a let property, access and communication with the tenant should be coordinated within the applicable agreements and rules.

Local owner representation can support practical coordination and documentation, but it does not replace brokerage, legal or tax advice. Following a clear instruction, STRATIQ supports local coordination, property appointments and documentable observations within an agreed and legally permissible scope.

  • Do not leave tenancy, finance or developer matters open until the transfer appointment
  • Obtain written confirmation of the power of attorney and accepted format in advance
  • Compare offers, approvals and desired net proceeds in a documented way
  • Reconcile DLD fees, payment route and original documents before the Trustee appointment
  • Clarify German tax and AWV questions early with qualified parties

FAQs about selling a Dubai property from Germany

01Can I sell my Dubai property without travelling there in person?

DLD describes sale registration for buyers and sellers or their legally authorised representatives. For a power of attorney issued in Germany, confirm the required form in advance with the Trustee Office, developer, lender and, where appropriate, legal advisers.

02Which documents does DLD list for a sale?

For individuals, DLD lists valid identification documents and, in freehold areas, an e-NOC from the developer. Further documentation depends, for example, on finance, ownership structure and property type.

03What is the DLD fee when selling?

DLD’s Property Sale Registration page currently lists 2% of the sale value for the seller and 2% for the buyer, plus possible further fees. Check current figures and the specific allocation of costs with DLD before signing.

04Can a gain on sale be taxable in Germany?

It can. Section 23 of the German Income Tax Act covers property sales within ten years, but includes, among other things, exceptions for certain owner-occupation cases. Individual tax effects must be reviewed using your facts.

05Does a payment to Germany have to be reported?

For German residents, the Bundesbank generally describes reporting requirements for certain cross-border payments exceeding EUR 50,000 or the equivalent. Whether it applies in your case depends on the person, payment route and underlying transaction.
